1. Introduction
These Terms govern access to and use of Socialiya, including its website, mobile applications, social features, reels, creator programmes, rewards, advertising, business/vendor services and marketplace features. “Socialiya”, “we”, “us” and “our” mean the entity operating Socialiya, having its registered office at India (details available on request), India. By registering, accessing or using Socialiya, you agree to these Terms and the policies incorporated into them.
2. Eligibility
You may use Socialiya only if legally permitted to do so. You must provide accurate registration information and must not impersonate another person or create an account for fraudulent purposes. Additional age or eligibility requirements may apply to particular services.
3. Account
You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account, except where caused by circumstances outside your reasonable control. Do not sell, rent, transfer or share your account.
4. User Content
Users may submit posts, photographs, videos, reels, audio, comments, reviews, links and other material. You remain responsible for your User Content and represent that you have the rights and permissions necessary to submit it.
5. Content License
By uploading User Content, you grant Socialiya a non-exclusive, worldwide, royalty-free licence, to the extent necessary to operate and promote the Platform, to host, store, reproduce, process, display, distribute, transmit, adapt and technically modify that content. You retain ownership of your original content.
6. Prohibited Content
Users must not upload or distribute unlawful content, fraud, phishing, malware, impersonation, copyright infringement, privacy violations, non-consensual private information, sexual exploitation, sexualisation of minors, credible threats, targeted harassment, unlawful hate content, spam, fake engagement or content that facilitates criminal activity.
7. Spam, Bots and Automation
Unauthorized bots, scraping, mass account creation, fake engagement, click farms, automated interactions and attempts to bypass technical controls are prohibited.
8. Creator and Reward Programmes
Socialiya may offer creator, referral and reward programmes subject to separate programme rules. Participation does not guarantee income. Eligibility, qualifying activity, verification, tax deductions and redemption requirements may apply.
9. Advertising
Socialiya may display advertisements. Advertisers are responsible for the legality and accuracy of their advertisements. Payment does not guarantee impressions, clicks, conversions or sales.
10. Business/Vendor Services
Businesses are responsible for the accuracy of listings, pricing, taxes, inventory, delivery, warranties, refunds, customer service and legal compliance.
11. Payments and Marketplace
Payments may be processed through third-party payment providers. Seller transactions may be subject to separate seller terms and applicable consumer law.
12. Intellectual Property
Socialiya and its licensors own the Platform software, design, trademarks, logos and original Platform materials. Unauthorized copying, reverse engineering, extraction or commercial exploitation is prohibited.
13. Reporting and Moderation
Socialiya may remove, restrict, demote or disable content or accounts where reasonably necessary for policy, legal, safety, security, fraud or rights-enforcement reasons.
14. Suspension and Termination
Accounts may be restricted, suspended or terminated for violations, fraud, security risks, unlawful activity, repeated abuse or lawful government/court requirements. Appeal mechanisms may be provided where applicable.
15. Privacy
Use of Socialiya is also governed by the Socialiya Privacy Policy and applicable Indian data-protection law.
16. Third-Party Services
Socialiya may integrate payment gateways, analytics, cloud services, advertising networks, authentication services and other third-party services. Their own terms may apply.
17. Disclaimer
To the maximum extent permitted by law, Socialiya is provided on an “as available” basis. Socialiya does not guarantee uninterrupted availability, perfect accuracy, guaranteed earnings, advertising performance or uninterrupted third-party services.
18. Liability
Nothing in these Terms excludes liability that cannot legally be excluded. To the maximum extent permitted by law, Socialiya will not be liable for indirect, incidental, special or consequential losses.
19. Indemnity
To the extent permitted by law, users are responsible for claims arising from their unlawful use, User Content, violation of these Terms or infringement of third-party rights.
20. Taxes
Unless otherwise stated, Socialiya charges Goods and Services Tax (GST) at 18% on taxable platform services, advertising services, fees and other taxable supplies, itemised on invoices. Users remain responsible for their own tax obligations. Socialiya may deduct or withhold amounts where required by law and may request PAN, GSTIN or other tax information.
21. Changes
Socialiya may modify services and these Terms. Material changes will be notified where required by law.
22. Governing Law
These Terms are governed by the laws of India. Subject to mandatory statutory rights, disputes shall be subject to the competent courts/tribunals at Kolkata, West Bengal, India.
